Rivers
- Regional Plan Committee – Awaiting Crown – meeting with Minister in June to discuss
- A mechanism to recognise Ngati Pahauwera tino rangatiratanga through day to day involvement in management of Rivers still a focus for negotiators – meeting with Minister in June to discuss
- Good Governance Initiative – scoping study – seeking funding for a cultural health assessment involving whanau and scientific research
DoC Redress
- DoC co-management charter – all minor issues agreed, awaiting confirmation from Ministers on cultural use of dead wildlife/marine mammals
- Te Heru O Tureia – good progress at last negotiation on conditions of Te Heru O Tureia giftback – awaiting drafting to confirm
- Return of DoC Lands – Putere still a focus, engaging again with Tuhoe – need assistance of Putere whanau to encourage Tuhoe
Overlapping Claims
- Ngati Pahauwera met with MTI on 3 and 4 May 2010 to resolve representation issues
- Still some way apart so Crown now meeting separately with parties
- Ngati Pahauwera met with hapu south of the Waikari River on 13 April 2010 to update on process
- Ngati Pahauwera remain committed to ensuring hapu south of Waikari River represented
- Meeting with MTI, MAI and Ngati Hineuru in early June regarding redress
Commercial Issues
- Right of first Refusal – Crown has confirmed 100 years right on any surplus Crown lands in core area
- Waipapa B3 and Kotemaori have been offered to Ngati Pahauwera as part of settlement subject to agreeing terms and conditions
- Wairoa DC properties to be returned
Historical Account
- Near final draft on 7 April 2010 – has now been sent to Crown Law for final comments and then will be edited to ensure clear and easy to understand
- Crown to provide first draft of acknowledgements next week
Foreshore and Seabed Review
- Public hui completed, and submissions closed on 30 April 2010
- Ngati Pahauwera made a submission on the proposal, copies of which are available on request
- Key features of Crown proposal include:
- ability to apply to Court or negotiate for recognition of territorial rights in Foreshore and Seabed
- redress if territorial rights are recognised include the ability to say no to coastal permits and DoC concessions for any reason – Ngati Pahauwera would have the final say
- Submission stated that this redress was appropriate, but Ngati Pahauwera need to see the wording of the tests and redress to ensure fair, and consistent with tikanga
- Crown confirmed still committed to negotiating Foreshore and Seabed settlement with Ngati Pahauwera – will not have to go to Court to have interests recognised
Timeframes
- Overall on track to complete major negotiating items by end June apart from:
- Rivers redress – still developing mechanism
- Regional Plan Committee:
- Meeting Minister early June
- HBRC to approve June
- Negotiations of Terms of Reference to finish late July
- Overlapping claims – continuing to work through issues
- Aiming to complete draft Deed of Settlement by mid August 2010
- Take out draft Deed of Settlement for ratification by Ngati Pahauwera from late August 2010
Upcoming Events
- Monthly hui a iwi to continue until ratification process commences – Counsel to attend next hui a iwi
- 2010 Trustees elections (3 trustees) to be advertised soon
- AGM will follow post elections
