QUESTIONS AND CLARIFICATION TO AND FROM THE OFFICE OF TREATY SETTLEMENTS
1. Right of Deferred Selection Process (DSP), what is it and what impact would it have on Ngati Pahauwera’s negotiations.
To purchase a property under a DSP Right, one is given an option to purchase between set time frames, or purchase the property outright or include a sale and lease back to the Crown. If one does not purchase a DSP property under these processes during the DSP selection period, such property becomes subject to a ‘Right of First Refusal (RFR) process.
2. Right of First Refusal Process (RFR), is when a property subject to this right is declared Crown Surplus. The Crown must offer it for sale to Ngati Pahauwera or whom ever applicable, prior to offering it for sale on the open market.
LANDBANKING APPLICATION UNDER THE PROTECTION MECHANISM
NPD & NPDT Trustees placed an application for consideration on Crown Surplus Land against criteria set by government. The powers that be, decide to either protect the property from sale in a Regional Land bank (for possible use in future Treaty Settlements) or release it for sale on the open market. We are interested in all Crown Surplus lands, we have a lot of whanau out there wanting to permanently return; why not have things in place for them and future generations.
PUBLIC ACCESS RIGHT OF WAY FOR MOHAKA FOREST
Pan Pac requested a shift from their present access to 2 – 3 hundred yards north of their present site. Their reason for this request was for safety sake of logging trucks crossing State Highway 2. Crown and LINZ are presently holding discussions regarding costs etc.
POUWHENUA / TUAHU SITES
Several locations have been discussed, pinpointed on a map of our Core Area of Interest and the Wider Area of Interest.
PLACE NAME CHANGES
Through the Geographic Board, we have a chance to revert place names, change insignificant names and correct misspelt names, free of charge. Correct Nakis Road to Naki Road (drop the ‘s’) insignificant name like Sims Road (Church Road) to Te Wainohu Road to complete the triangle of our tipuna e.g Te Kahu-o-te-rangi (whare tipuna), Rongomaiwahine (Round hall) and Te Wainohu Road. Other names are changing as well.
RIVERS’ REDRESS
Our CNN (Chief Crown Negotiator) Fran Wilde has been meeting with HBRC, the regional councils, the territorial authorities and all iwi within the rohe; NCC, HDC, CHBDC and WDC – Napier City Council, Central Hawkes Bay District Council and Wairoa Distrcit Council regarding the Co-management Plan. The Plan will deal with all waterways within the HB region.
When a particular problem arises in a certain area, the tangata whenua of the rohe will deal with it. The Committee that will be set up will consist of up to 8 iwi representatives and up to 8 Councillors. Agreement is by consensus. All must agree or a motion will not be accepted. This is how the Plan looks at this time.
DRAFTING OF THE DEED OF SETTLEMENT
Before the 10 October, NPDT will receive the next version of the Deed from the Crown Department responsible for writing up such documents. Much work is still to be done. NPDT is at the point where the ‘wording’ is scrutinisted fully and precisely. NPDT & NPTT, must ensure that what is in this Deed will not be misconstructed in the generations to come. Kaitiakitanga, rangatiratanga, manaakitanga, mauritanga, wairuatanga and orangatanga will not be returned to poharatanga.
DEED OF SETTLEMENT
Through no fault of NPDT or NPTT the expected conclusion of our Negotiation Settlement will now be at the latest, March 2010.
